Terms of Service

By accepting this estimate, authorizing work, paying a deposit, or permitting Homegrown Outdoors to begin work, the Customer agrees to the following Terms & Conditions.

1. SCOPE OF WORK

Homegrown Outdoors will perform only the work specifically described in the accepted estimate. Any additional work requested by the Customer or determined to be necessary after work begins may require a written or verbal change authorization and may result in additional charges.

Trees, limbs, stumps, areas of vegetation, or other items to be serviced should be clearly identified prior to work beginning. The Customer is responsible for reviewing the scope of work and notifying Homegrown Outdoors of any questions or requested changes before work begins.

2. ESTIMATE & PRICING

Unless otherwise stated, estimates are valid for 30 days from the date issued.

Pricing is based upon conditions reasonably visible or known at the time of the estimate. Additional charges may apply if previously unknown or concealed conditions are discovered, including but not limited to:

  • Internal tree decay, cavities, structural defects, or hazardous conditions;
  • Embedded metal, concrete, fencing, cables, or other foreign materials;
  • Underground utilities, irrigation, septic systems, drainage systems, invisible fencing, or other underground improvements;
  • Restricted or changed equipment access;
  • Unexpected site conditions; or
  • Additional work requested by the Customer.

Homegrown Outdoors will make reasonable efforts to obtain Customer approval before performing additional billable work when circumstances permit.

3. PROPERTY ACCESS

The Customer grants Homegrown Outdoors and its employees, subcontractors, vehicles, and equipment reasonable access to the property necessary to perform the contracted services.

The Customer is responsible for ensuring that gates, driveways, access points, and work areas are accessible and for removing vehicles, furniture, decorations, toys, pets, and other movable property from the work area.

If access is unavailable at the scheduled time, additional trip, mobilization, or rescheduling charges may apply.

4. UNDERGROUND & CONCEALED CONDITIONS

The Customer must disclose the known location of private underground or concealed improvements that may not be identified through public utility locating services, including irrigation systems, landscape lighting, invisible fencing, private electrical lines, septic systems, drain fields, wells, private water lines, pool equipment, drainage systems, and similar improvements.

Homegrown Outdoors is not responsible for damage to undisclosed, incorrectly marked, or improperly located underground or concealed improvements except to the extent otherwise required by law.

5. TREE & LANDSCAPE CONDITIONS

Trees are living organisms and may contain defects or conditions that are not visible before work begins. Homegrown Outdoors cannot guarantee the future health, stability, appearance, growth, or survival of any tree, shrub, turf, or other vegetation unless specifically stated in writing.

Pruning may change the appearance, density, balance, or shape of a tree. The Customer acknowledges that final appearance may vary based upon tree structure, health, species, accessibility, and accepted pruning practices.

6. TREE REMOVAL

Tree removal pricing includes only the work specifically identified in the estimate.

Unless specifically included:

  • Stump grinding is not included with tree removal;
  • Removal of underground roots is not included;
  • Removal of stump grindings is not included;
  • Backfilling, sod replacement, landscaping, or restoration is not included; and
  • Replacement of removed trees or vegetation is not included.

Once a tree has been removed, it cannot be restored. The Customer is responsible for confirming that the correct tree or trees have been designated for removal.

7. STUMP GRINDING

Stump grinding will be completed only when specifically included in the estimate and only to the extent reasonably accessible by Homegrown Outdoors’ equipment.

Stump grinding does not remove the entire underground root system. Roots may remain and may continue to decay, settle, or affect the surrounding soil.

Unless specifically stated otherwise, removal of grindings, installation of fill material, grading, sod, seed, landscaping, or restoration is not included.

8. DEBRIS & CLEANUP

Debris generated by the contracted work will be removed only when removal is included in the estimate.

Normal cleanup does not include complete removal of sawdust, small wood particles, leaves, minor twigs, stump grindings, or material embedded in turf or landscaping unless specifically stated.

Firewood, logs, wood chips, or mulch will remain on the property only when specifically requested and agreed upon.

9. LAWN, LANDSCAPE & PROPERTY IMPACT

Tree and land-clearing services require the use of heavy equipment and may result in temporary or minor disturbance to lawns, landscaping, driveways, sidewalks, curbs, or other surfaces.

Homegrown Outdoors will exercise reasonable care to minimize property disturbance. Normal and unavoidable effects of performing the contracted work, including tire impressions, minor turf disturbance, sawdust, debris, or soil compaction, are not considered property damage.

The Customer should identify areas that require special protection before work begins.

10. FENCES, GATES & ACCESS STRUCTURES

If fencing, gates, landscaping, or other structures must be removed or modified to provide equipment access, such work must be specifically included in the estimate.

Homegrown Outdoors is not responsible for restoring items removed by the Customer or another contractor unless restoration is specifically included in the agreed scope of work.

11. UTILITIES

Homegrown Outdoors will follow applicable requirements concerning public utility locating.

The Customer is responsible for identifying privately installed utilities or systems that are not located through public utility-marking services.

Work may be delayed or modified when utility conflicts create an unsafe condition.

12. PERMITS, HOA & PROPERTY AUTHORIZATION

Unless specifically stated in the estimate, the Customer is responsible for determining and obtaining any required homeowner association, neighborhood, municipal, county, environmental, or other approvals related to the requested work.

The Customer represents that they own the property or have legal authority to authorize the requested work.

Any permit or administrative fees not specifically included in the estimate may be charged separately.

13. PROPERTY LINES & NEIGHBORING PROPERTY

The Customer is responsible for accurately identifying property boundaries and obtaining permission for work involving trees, vegetation, access, or property that is owned wholly or partially by another person.

Homegrown Outdoors may decline or suspend work when ownership, boundary, or authorization is disputed.

The Customer agrees not to direct Homegrown Outdoors to remove or materially alter trees or property belonging to another person without appropriate authorization.

14. WEATHER & UNSAFE CONDITIONS

Scheduling is subject to weather, ground conditions, equipment availability, emergencies, and other conditions affecting safe operations.

Homegrown Outdoors may postpone, suspend, or reschedule work when conditions are unsafe or when proceeding could create unreasonable risk to personnel, customers, property, or equipment.

Weather-related or safety-related delays do not constitute abandonment or breach of the agreement.

15. STORM & EMERGENCY WORK

Storm-damaged trees may contain unpredictable loading, broken limbs, suspended branches, uprooted root systems, electrical hazards, or other concealed dangers.

If conditions materially differ from those visible when the estimate was prepared, Homegrown Outdoors may suspend work and provide revised pricing before continuing.

Emergency, after-hours, specialized-equipment, or hazardous-condition charges may apply when disclosed and authorized.

16. PAYMENT TERMS

Payment terms will be stated on the estimate or invoice.

Unless otherwise agreed in writing, payment is due upon completion of the contracted work.

Any required deposit must be received before the project is placed on the work schedule.

Additional authorized work will be added to the final invoice.

Returned payments, chargebacks, collection expenses, and past-due balances may be subject to additional charges to the extent permitted by applicable law and the parties’ agreement.

17. CANCELLATION & RESCHEDULING

Customers should provide as much advance notice as reasonably possible when requesting cancellation or rescheduling.

Deposits, mobilization charges, permit fees, special-order materials, equipment reservations, subcontractor expenses, or other costs already incurred may be non-refundable to the extent permitted by law.

Where a transaction is subject to a statutory cancellation right, the applicable statutory cancellation provisions will control.

18. WORKSITE SAFETY

Customers, children, pets, visitors, and other persons must remain outside the designated work area while operations are underway.

The Customer agrees not to enter an active work zone or interfere with equipment or personnel without authorization from a Homegrown Outdoors representative.

19. COMPLETION & CUSTOMER CONCERNS

The Customer should inspect the completed work as soon as reasonably practical and promptly notify Homegrown Outdoors of any concern regarding the agreed scope of work.

Homegrown Outdoors must be provided a reasonable opportunity to inspect and, when appropriate, address a claimed deficiency before another contractor performs corrective work.

20. PHOTOGRAPHS

Homegrown Outdoors may photograph the work area before, during, and after services for documentation, safety, training, quality-control, and recordkeeping purposes.

Photographs containing identifiable persons, addresses, license plates, or other personal information will not be used for advertising without appropriate authorization.

21. LIMITATION TO CONTRACTED SERVICES

Homegrown Outdoors is responsible only for services included within the accepted scope of work. Recommendations, observations, or conversations concerning other trees, landscaping, drainage, grading, or property conditions do not constitute an agreement to perform additional services unless added to the approved scope.

22. CHANGES TO THE AGREEMENT

Changes to the scope, pricing, or other material terms should be documented through an updated estimate, change order, electronic approval, text message, email, or other written authorization.

23. ENTIRE AGREEMENT

The accepted estimate, these Terms & Conditions, approved change orders, and any incorporated written specifications constitute the agreement between Homegrown Outdoors and the Customer concerning the contracted services.

If any provision is determined to be unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

24. ACCEPTANCE

Acceptance of the estimate electronically, in writing, through payment of a requested deposit, or by otherwise authorizing Homegrown Outdoors to proceed constitutes acknowledgment and acceptance of the estimate and these Terms & Conditions.
